Jensen Beach- On Thursday, March 4th, a Lunch & Learn with Johnny’s Half Shell along with the Palm City Chamber of Commerce was held. The restaurant is located at 1868 NE Jensen Beach Blvd. in Jensen Beach.

John Spoto and Kelly Spoto talked about oysters and John Spoto did a demostration showing everyone how to shuck oysters. He also talked about all the many kinds of oysters that are available. Food was served and sooooo delicious!

At Johnny’s Half Shell there are lots of daily specials featuring Buck-a-Shuck Thursday with Happy Hour foods and drink promotions from 3:00 – 6:00pm.

The Mission at the Palm City Chamber is “To serve as the principle advocate of the community and its businesses, acting as the catalyst in promoting the economic development of the Palm City area, stimulating jobs and improving the quality of life.”

When a doctor’s office or other medical care provider is committing Medicare fraud, there is always a trail that can be followed. Unfortunately, it is impossible for the Medicare system to follow up on every claim that is made to ensure it is all legitimate. This is why it is actually the patient that is the first line of defense against this costly form of fraud. Whenever you receive care, make sure to watch for the following things:

Extra Billing – You should receive a bill or other document that shows what services you received and their cost. If you notice services or equipment on there that you didn’t actually receive, this is likely evidence of Medicare fraud.
Offer of Free Testing – There are many tests and services that are 100% covered by the Medicare system. Medical service providers often offer these services to people free of charge in exchange for their Medicare number. You never want to get a test just because it is free! This is just the provider trying to get extra money from the system.
Pushing for Unnecessary Services – It is often difficult to know what tests and procedures are necessary, and it is important to be able to trust your doctors. You should, however, always ask what the purpose of a specific test or procedure is. If they can’t explain why it is medically necessary, they simply are trying to inflate the bill they will send to Medicare.
Waiving a Deductible – While it may sound nice that a doctor’s office is going to waive a deductible, it could be a sign that they are engaged in Medicare fraud. They may do unnecessary tests or procedures because of the money they can make rather than because it is medically necessary.

In many of these examples, and others involving Medicare fraud, you are put in real danger. Whenever you receive unnecessary tests, medications, or procedures, there is a risk to your health. This is why it is so important to be an active participant in the care you receive. There are ways to report suspected Medicare fraud so the proper agencies can perform an investigation. Elder Law Basics: The Assisted Living Waiver

If you or a loved one needs to move into an assisted living home of any type, you will want to learn about the assisted living waiver. This is a program offered by the State of Florida to help make it easier for elderly residents to get the care they need. It will typically be a part of the Statewide Medicaid Managed Care Program. Whether you need this right away or you are just planning for the future, understanding the assisted living waiver will help ensure you have everything you need.

What Exactly Is it?

The state of Florida has a large number of elderly residents, which means they have a large number of people who need help with day to day activities. In many areas, there simply aren’t enough rooms in an actual assisted living community or nursing home, which is why this waiver was created. Those who are able can remain living at home and use the waiver to pay for the day to day care that they require. The services that can be provided with this waiver include things like adult companion services, adult day care, attendant care, home accessibility adaptation, home delivered meals, skilled nursing, medical equipment, nutritional assessment, personal care, and more. For many people, this is the ideal way to maintain as much independence as possible while still getting the care and help they need.

Who Qualifies?

There are two main eligibility requirements that need to be met in order to get the assisted living waiver. First, your health must require nursing home care. This will be determined by your doctor, and the criteria are set by the Comprehensive Assessment and Review for Long-Term Care Services (CARES) team in Florida. Additionally, you will need to meet certain financial requirements. An application will only be approved if your monthly income is below $2205, and your assets are not above $2000 ($3000 if you are a married couple).

These financial restrictions often seem quite severe, but there are a number of things that can make it easier to qualify. First, if you are married, the non-application spouse can keep up to $120,900 in assets, and additionally, can receive up to $3022.50 per month before there is any impact to the eligibility. For many people, a Miller Trust can be used to funnel income into a trust so that it is not counted toward the income limitations. Talking to an estate planning attorney will help you to determine the best way for you to qualify.

Famous People Who Failed to Plan Properly

Out2News.comIt’s almost impossible to overstate the importance of taking the time to plan your estate. Nevertheless, it’s surprising how many American adults haven’t done so. You might think that those who are rich and famous would be way ahead of the curve when it comes to planning their estates properly, considering the resources and lawyers presumably available to them. Yet there are plenty of celebrities and people of note who died with inadequate (or nonexistent) estate plans.
Most recently
The Queen of Soul, Aretha Franklin, died in 2018, leaving behind a score of wonderful music and countless memories. But it appears Ms. Franklin died without a will or estate plan in place. Her four sons filed documents in the Oakland County (Michigan) Probate Court listing themselves as interested parties, while Ms. Franklin’s niece asked the court to appoint her as personal representative of the estate.
All of this information is available to the public. Her estate will be distributed according to the laws of her state of residence (Michigan). In addition, creditors will have a chance to make claims against her estate and may get paid before any of her heirs. And if she owned property in more than one state (according to public records, she did), then probate will likely have to be opened in each state where she owned property (called ancillary probate). The settling of her estate could drag on for years at a potentially high financial cost.
A few years ago
Prince Rogers Nelson, who was better known as Prince, died in 2016. He was 57 years old and still making incredible music and entertaining millions of fans throughout the world. The first filing in the Probate Court for Carver County, Minnesota, was by a woman claiming to be the sister of Prince, asking the court to appoint a special administrator because there was no will or other testamentary documents. As of November 2018, there have been hundreds of court filings from prospective heirs, creditors, and other “interested parties.” There will be no private administration of Prince’s estate, as the entire ongoing proceeding is open and available to anyone for scrutiny.
A long time ago
Here are some other notable personalities who died many years ago without planning their estates.
Pablo Picasso died in 1973 at the ripe old age of 91, apparently leaving no will or other testamentary instructions. He left behind nearly 45,000 works of art, rights and licensing deals, real estate, and other assets. The division of his estate assets took six years and included seven heirs. The settlement among his nearest relatives cost an estimated $30 million in legal fees and other related costs.
The administration of the estate of Howard Hughes made headlines for several years following his death in 1976. Along the way, bogus wills were offered; people claiming to be his wives came forward, as did countless alleged relatives. Three states — Nevada, California, and Texas — claimed to be responsible for the distribution of his estate. Ultimately, by 1983, his estimated $2.5 billion estate was split among some 22 “relatives” and the Howard Hughes Medical Institute.
Abraham Lincoln, one of America’s greatest presidents, was also a lawyer. Yet when he met his untimely and tragic death at the hands of John Wilkes Booth in 1865, he died intestate — without a will or other testamentary documents. On the day of his death, Lincoln’s son, Robert, asked Supreme Court Justice David Davis to assist in handling his father’s financial affairs. Davis ultimately was appointed as the administrator of Lincoln’s estate. It took more than two years to settle his estate, which was divided between his surviving widow and two sons.

5 Myths About Living Trusts

Living trusts are an important part of many people’s overall estate plan. They offer a variety of advantages and can be used in many different ways. Due to their popularity, however, there are also a lot of myths surrounding living trusts, some of which could end up costing you thousands of dollars. Read about these myths and what makes them false so you don’t make the same mistakes that others have.

Living Trusts Will Help You Avoid Estate Taxes

This is likely the most common myth, and with good reason. Most people associate trusts and other estate planning with tax avoidance. While there are certainly steps that can be taken (some of them even including trusts of different types) to reduce your estate taxes, a living trust isn’t one of them.

Once a Living Trust is Created it Can Be Ignored

As with all estate planning efforts, a living trust needs to be looked at and reviewed from time to time to ensure it is still optimized based on changes to estate planning law. You’ll also want to continue to fund your living trust as your assets grow and change. Even if your estate is essentially static, you will still want to review your living trust at least once a year with an estate planning attorney.

A Living Trust Will “Hide” Assets from Medicaid for Purposes of Long-Term Care

This is a very dangerous myth, which could cost you thousands of dollars. If you need to live in a long-term care facility, you will likely want Medicaid to step in to cover the expenses. If you have too many assets, Medicaid will require you to use those assets to pay for your care until they are gone. In almost all cases, moving ownership of assets into a living trust won’t be sufficient on its own to pacify Medicaid. There are strategies that can be put in place to protect your assets from Medicaid, but a living trust alone isn’t one of them.

A Living Trust is All You Need

A living trust is a great estate planning tool, there is no doubt about that. To suggest that it is the only one you need, however, is a mistake. Everybody’s situation is going to be unique, and their estate plan should reflect this. Using a living trust may be a good idea for you, or there may be other estate planning vehicles that might be better. Working with an experienced attorney is the best way to know for sure.

A “Do it Yourself” Living Trust is Just Fine

There are “do it yourself” style options for just about everything today, and they can be quite tempting. The fact is, however, that living trusts are absolutely not a “one-size-fits-all” type of legal document. I Received a Large Refund on my Tax Return this year. Should I Adjust my Withholding?

Out2News.comYou must have been pleasantly surprised to find out you’d be getting a refund from the IRS — especially if it was a large sum. And while you may have considered this type of windfall a stroke of good fortune, is it really?

The IRS issued over 112 million federal income tax refunds, averaging $2,895, for tax year 2016.1 You probably wouldn’t pay someone $240 each month in order to receive $2,900 back, without interest, at the end of a year. But that’s essentially what a tax refund is — a short-term loan to the government.

Because you received a large refund on your tax return this year, you may want to reevaluate your federal income tax withholding. That way you could end up taking home more of your pay and putting it to good use.

When determining the correct withholding amount, your objective is to have just enough withheld to prevent you from having to owe a large amount of money or scramble for cash at tax time next year, or from owing a penalty for having too little withheld.

It’s generally a good idea to check your withholding periodically. This is particularly important when something changes in your life; for example, if you get married, divorced, or have a child; you or your spouse change jobs; or your financial situation changes significantly.

Furthermore, the implementation of the new tax law at the beginning of 2018 means your withholding could be off more than it might be in a typical year. Employers withhold taxes from paychecks based on W-4 information and IRS withholding tables. The IRS released 2018 calculation tables reflecting the new rates and rules earlier this year. Even so, the old W-4 and worksheet you previously gave to your employer reflect deductions and credits that have changed or been eliminated under the new tax law.

The IRS has revised a useful online withholding calculator that can help you determine the appropriate amount of withholding. You still need to complete and submit a new W-4 to your employer to make any adjustments. Visit irs.gov for more information.

Moving the Cloud Closer to the Business

We will soon reach the point where connectivity to cloud resources is going to become a serious issue in terms of real-time computing functions. So, how do we bring the cloud closer to us?

Having all the data in the world is worthless if we can’t quickly access and analyze it in real-time. The advent of cloud computing has solved many enterprise IT challenges in the wake of the digitization of the business landscape. Cloud elasticity, scalability and security allow organizations to accomplish things never thought possible, thanks to the elimination of massive up-front infrastructure costs.

This has led to big data analytics, the Internet of Things (IoT) and artificial intelligence (AI), among other new business practices. Yet with all the advancements inside the cloud, it leaves many of us with one final problem — connectivity to the cloud.

While bandwidth and latency can be managed with relative ease when working with private clouds and leased lines, most companies are moving toward the use of public clouds and the use of Internet broadband connections to access cloud content. This shift has led to an increase in the adoption of technologies such as WAN optimization and SD-WAN to help improve and control speed and latency in accessing the cloud.

Another issue to consider is that your end users are likely accessing company cloud resources outside the corporate LAN. More than ever before, workforces are becoming mobile. What this means is that cloud data must be accessible no matter who the user is, where they are located, or what device is used. This issue becomes incredibly complex for IT administrators because the use of the public cloud and Internet broadband technologies to access the cloud means they lack the ability to control the network between the end user and that cloud. The further away a user is from the cloud, the more likely they are to run into connectivity and latency problems that can impact the usefulness of a real-time application.

No Tipping at NY Restaurants?

Is this a trend coming soon to a town near you?

When you head on up to New York for that new Broadway show or the Macy’s Christmas Parade you need to be aware that in some trendy restaurants there will be no need to tip. It is being reported that Union Square Hospitality Group will be eliminating tipping, starting next month.

“Starting at The Modern in late November, you will no longer find a tip line on your check, and there will be no need to leave additional cash at the table, the coat check, or the bar,” said Danny Meyer owner of the USHG. “Once these changes are implemented, the total cost you pay to dine with us won’t differ much from what you pay now. But for our teams, the change will be significant. We will now have the ability to compensate all of our employees equitably, competitively and professionally. And by eliminating tipping, our employees who want to grow financially and professionally will be able to earn those opportunities based on the merit of their work.”
